Welcome to Repartee. These Terms of Use ("Terms") are the agreement between you and the operator of Repartee. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use Repartee.
Repartee is operated by Thomas Debay, sole trader (entrepreneur individuel) established in France ("Repartee", "we", "us").
Our full legal notice (mentions légales), including our hosting providers, is set out in the Privacy Policy (Section 1).
Repartee is a conversation app for multilingual professionals practising spoken English. You record short voice messages ("vocals"), respond to other users' vocals, and take part in conversation threads. The app sends you prompts and feedback to help you practise.
Repartee is newly launched and currently offers a limited set of features. That means:
You must be at least 18 years old to use Repartee. By using it, you confirm you meet this requirement and that the information you give us is accurate.
Anyone who meets these requirements can create an account. We may limit, suspend, or revoke access on the grounds set out in Section 10 (Suspension and termination).
You keep ownership of the voice recordings, messages, and other content you create on Repartee ("Your Content").
To run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and play Your Content for the purpose of operating and improving Repartee — including making your vocals available to other users, and monitoring and reviewing your content to operate and improve the service.
By design, when another user replies to one of your vocals, that vocal becomes the seed of a community conversation thread. You agree that:
If you are not comfortable with your recordings being heard by others while your account is active, do not record them.
You are responsible for what you record and send. You must not post content that:
We may remove content or suspend accounts that breach these Terms.
Repartee has zero tolerance for objectionable content and for abusive users. There is no tolerance for content that is abusive, harassing, hateful, threatening, sexually explicit, or otherwise objectionable, nor for users who behave abusively toward others. When we become aware of such content or conduct — whether through a user report or our own review — we will act within 24 hours to remove the content and to suspend or permanently remove (eject) the offending account. By using Repartee you agree to this standard and accept that breaching it will lead to removal of your content and loss of your account.

Repartee is a space for people practising a second language. Treat other users with patience and respect — imperfect English is the point, not a fault.
Repartee sends prompts and feedback to help you practise. Your conversations and recordings may be monitored and reviewed by Repartee to operate the service, provide that feedback, and improve the product. The prompts, statements, and feedback are for language practice and entertainment only — they are not professional, educational, medical, legal, or other expert advice, and may be deliberately provocative "half-truths" intended to spark conversation.
Because Repartee is an early-stage service, we provide it "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We may modify, suspend, or discontinue any part of the service at any time.
Nothing in these Terms removes or limits any rights you have as a consumer under mandatory French or EU law that cannot legally be excluded.
Repartee, its name, logo, software, prompts, and design are owned by us or our licensors. These Terms do not give you any right to use them except as needed to use the app normally.
Where it is reasonable to do so, we will tell you why we have taken action and, for less serious or first-time issues, we may warn you or remove specific content rather than suspend your account. For serious or repeated breaches we may suspend or terminate immediately.
What happens to your data on termination is explained in the Privacy Policy — including the exception for community threads in Section 5.3.
To the maximum extent permitted by law, we are not liable for indirect or unforeseeable losses arising from your use of a free, early-stage service. Nothing in these Terms limits our liability for gross negligence (faute lourde), for death or personal injury — whether bodily or moral harm — caused by our negligence, for fraud, or for anything that cannot be limited under applicable law, including your non-waivable rights as a consumer under French law.
We may update these Terms as Repartee develops, and we will always update the "Last updated" date. For minor changes, we will notify you in the app or by email. For material changes, we will ask you to review and actively accept the updated Terms before you continue using Repartee — we will not treat continued use on its own as your acceptance of a substantial change.
These Terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

For consumers in France: after contacting us, you may also be entitled to use a consumer mediation service (médiation de la consommation). The competent courts are those designated by applicable law; for consumers, this includes the courts of your place of residence.
